Terms of Service

Givays is operated by Moldech LLC, a Delaware limited liability company (“Givays”, “we”, “us”). By creating an account or using the Givays app, you agree to these Terms of Service and to our Privacy Policy. If you do not agree, do not use the app.

To use Givays and enter any giveaway, you must:

• Be at least 18 years of age
• Provide accurate registration information, including your date of birth
• Maintain only one account
• Reside in a location where the giveaway is offered and where participation is lawful

We may verify eligibility at any time and may disqualify entries or close accounts that do not meet these requirements.

You are responsible for keeping your login credentials secure and for all activity under your account. Notify us at support@givays.com if you believe your account has been accessed without your permission. You may delete your account at any time from within the app or at givays.com/delete-account.

• Each campaign displays a short brand slideshow or video.
• Viewing the full presentation unlocks the entry button for that campaign.
• One entry is permitted per person, per campaign.
• Winners are selected at random from all eligible entries after the campaign closes.
• Winners are notified in the app and by email.

Viewing brand content unlocks your entry only. It does not alter or improve your chances of being selected.

No purchase or payment of any kind is necessary to enter or win, and making a purchase will not increase your chances of winning. As an alternative to viewing brand content, you may enter any giveaway by mail at no cost. Full instructions appear in each campaign’s Official Rules and in the app.

Each giveaway is administered by Moldech LLC. The prize for a given campaign is provided by the advertiser named in that campaign. Official Rules are available for every campaign inside the app.

Apple Inc. is not a sponsor of, and is not involved in, any giveaway offered through this app in any manner. Google LLC is likewise not a sponsor of, and is not involved in, any giveaway offered through this app.

• Physical prizes are shipped by the advertiser. To receive one, you must provide a valid shipping address, which we share with that advertiser for fulfillment only.
• Digital prizes are delivered to the email address on your account.
• Service prizes are redeemed using a unique code issued in the app.

Prizes are not transferable and cannot be exchanged for cash. Unclaimed prizes may be forfeited after the period stated in the campaign’s Official Rules. You are responsible for any taxes arising from a prize you receive.

You agree not to:

• Create multiple accounts or enter a campaign more than once
• Use bots, scripts, emulators, or automated means to view content or submit entries
• Misrepresent your identity, age, or location
• Interfere with, disrupt, or attempt to gain unauthorized access to our systems
• Resell, transfer, or commercialize access to the app or any prize

We use anti-fraud measures to detect abuse and may void entries, withhold prizes, or terminate accounts that violate these rules.

You can report any campaign or block an advertiser at any time from within the app. We review reports and may remove content or suspend advertisers that violate our policies.

The Givays app, its design, and its content are owned by Moldech LLC or its licensors and are protected by intellectual property laws. Brand names, logos, and campaign materials belong to the respective advertisers. You may not copy, modify, or distribute any part of the app without our written permission.

You may stop using Givays and delete your account at any time. We may suspend or terminate your access if you breach these Terms, if we suspect fraud, or if required by law. Entries associated with a terminated account may be voided.

The app is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not guarantee that the app will be uninterrupted or error-free, and we are not responsible for the quality, safety, or delivery of prizes supplied by advertisers.

To the maximum extent permitted by law, Moldech LLC will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the app. Our total liability for any claim relating to the app or a giveaway will not exceed the value of the prize at issue or USD 100, whichever is greater.

We may update these Terms from time to time. When we do, we will revise the “Last Updated” date above. Continuing to use the app after a change means you accept the revised Terms.

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law rules. Individual giveaways may also be subject to the laws of the territory in which they are offered, as stated in the applicable Official Rules.
